Accessing our Service or booking a charter signifies your agreement to these Terms. Should you reject any part of these terms, you are not permitted to use the Service.

2. Service Overview

StarLitBenchWay offers luxury yacht charter services, which include:

• Rentals on a daily basis
• Evening sailings
• Company getaways
• Exclusive event bookings
• Extended charter excursions

Our services are provided based on current availability and prevailing weather conditions. We retain the authority to make adjustments or suspend services without prior notification.

3. Booking and Reservations

3.1 Booking Process

Booking prerequisites include:

• Being 18 years old or older
• Supplying valid and comprehensive details
• Remitting a specified deposit as outlined in the booking confirmation
• Consenting to these Terms & Conditions

3.2 Confirmation

A reservation is considered confirmed only after we've processed your payment and provided written confirmation. We hold the right to decline service to anyone based on our discretion.

3.3 Availability

Our charters are contingent upon vessel availability and favorable weather conditions. Efforts will be exerted to accommodate your scheduling preferences.

4. Payment Terms

4.1 Pricing

Prices are listed in € and are inclusive of applicable taxes unless specified otherwise. Pricing is subject to change without prior notification.

4.2 Payment Schedule

• Deposit: 50% of the entire charter fee payable at the time of booking
• Final payment: Required 48 hours prior to the departure of the charter
• Any other expenses (if applicable): Payable at the end of the charter

4.3 Payment Methods

We accept main credit cards, direct bank transfers, and certified checks. Our secure, encrypted platforms ensure safe processing of payments.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• Over 72 hours before departure: Complete refund except transaction fees
• Within 24 to 72 hours before departure: Refund of 50%
• Less than 24 hours before departure: No refund

5.2 Weather Cancellations

Charter cancellations due to unsafe weather as determined by our captain will be handled by either:

• Rescheduling at no extra cost to the earliest possible date
• Issuing a full refund if rescheduling isn't feasible

5.3 Mechanical Issues

If mechanical faults occur with the designated vessel, we will endeavor to provide an equivalent replacement. Should a substitute not be available, a full refund will be granted.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Adhere to the crew's instructions
• Use provided safety gear when needed
• Disclose any health issues that could impact their safety
• Stay within assigned areas on the vessel

6.2 Prohibited Items

The following are not allowed on the yacht:

• Glassware
• Illegal substances
• Firearms or other weaponry
• Excessively large quantities of beverages (excluding reasonable quantities for personal consumption)
• Pets (without prior approval)

6.3 Conduct

Passengers are expected to behave respectfully. A charter may be cut short without refund if a passenger's actions are deemed a danger to safety or disruptive to the journey.

7. Liability and Insurance

7.1 Our Liability

Our liability is limited strictly to the cost of your charter. We are not liable for:

• Injuries incurred due to a passenger's own actions
• The loss or damage of personal belongings
• Indirect, incidental, or punitive damages
• Delays affected by weather or events beyond our influence

7.2 Insurance Coverage

Comprehensive marine insurance is in place for our vessels and operations. Passengers should secure their travel and private insurance.

7.3 Assumption of Risk

By choosing to partake in our charters, you recognize that marine ventures come with inherent dangers and you accept sole responsibility for your personal safety and health.

8. Modifications and Itinerary Changes

We retain the right to alter tour paths, timetables, or itineraries owing to elements such as weather, safety, or operational needs. We will strive to secure similar alternative arrangements when possible.

9. Force Majeure

We are not responsible for any service delays, alterations, or cancellations brought about by circumstances outside our control, including, but not restricted to:

• Extreme weather conditions
• Natural catastrophes
• Governmental restrictions
• Shutdowns of ports
• Vessel malfunctions

10. Privacy and Data Protection

Your personal data is managed in line with our Privacy Policy. Through your utilization of our services, you agree to our use of your information as detailed within our Privacy Policy.

11. Intellectual Property

The content on our website including texts, graphics, logos, and images is safeguarded by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is strictly prohibited without our written consent.

12. Governing Law

The application of these Terms is governed by the laws in France. Any disputes should be settled in the courts situated in Nice, France.

13. Changes to Terms

We reserve the exclusive right to modify these Terms at our discretion. Any amendments will be posted on our website and the revision date updated. Continuous use of our services suggests acceptance of the modified terms.
